These General Terms and Conditions govern the relationship between Sellers and Consumers (customers) who use the online store www.emart.eu to purchase goods. By clicking on an object, image, link (other than that of the General Terms) or a button located on the website www.emart.eu, it is considered that you accept or agree with the General Terms and Conditions described below. These General Terms and Conditions comply with the requirements of the Consumer Protection Act (CPA) with the following website https://kzp.bg/, as well as with other regulations in force in the Republic of Bulgaria. We would like to inform you that from 09.01.2016. The electronic platform for online resolution of consumer disputes (ODR platform) has been launched - its address is http://ec.europa.eu/consumers/odr/

    DEFINITIONS

"SELLER" is the website www.emart.eu, which is owned by MARTBG LTD. and serves as a virtual platform for the sale of goods. The Seller is the person with whom the User enters into a distance sales contract for a specific product (item) in the e-shop.

"USER" is an actual person who has agreed to these Terms and Conditions in connection with the ordering and purchase of goods offered in the e-shop.

"E-SHOP" is the website www.emart.eu, which serves as a virtual platform for offering goods for sale and for reaching an agreement between SELLER and USER, for ordering and buying and selling a specific product (item).

MARTBG LTD is a Bulgarian company with UIC: 200172226, with headquarters in the city of Burgas, Lazur, 97  www.emart.eu has the full rights to unilaterally change the content of the Internet site, as well as the ways of access to it.

"ORDER" is the order made by the User to the e-shop for the purchase of one or more specific goods (items). The goods are packaged and shipped by courier to a pre-specified address in the order by the User, after being approved by email or phone. Approval by email is done by sending an email (email) for confirmation. Approval by phone is made after a call from an employee of the online store for confirmation.

"SALE AGREEMENT" is the contract concluded at a distance through this e-shop for the purchase and sale of goods between Seller and User.

"COURIER" is a trader who physically delivers the purchased goods to the address specified by the User and works under the requirements of the Postal Services Act.

"/SUBSCRIPTION /BROCHURE / NOTICE" are electronic information messages relating to goods sold in the e-shop during a certain period of time, which may be posted on the Website, and may also be sent by e-mail to the User.
 
2.0 TERMS AND CONDITIONS FOR USING THE SITE

2.1. Browsing the online store www.emart.eu is completely free and accessible from anywhere in the world.

2.2. In order to shop in www.emart.eu the User is provided with several opportunities:

         - By registering with email, password, name, address and phone number (with this method you can track your old orders)

         - Shopping as a guest, after filling in all required fields

         - Quick login with Facebook or Google

2.3. MARTBG EOOD is a registered administrator of personal data within the meaning of the Personal Data Protection Act (PDPA) and has the right to collect, process and use the personal data of its users in view of the needs of the e-shop, while having the obligation to keep these personal data, not to use them for other purposes, nor to provide them to third parties, except for the Sellers in the store.

2.4. In the e-shop www.emart.eu for each product is indicated the price, the main characteristics of the product and additional information aimed at helping to make an informed choice when buying the product.

2.5. All prices listed on the site are final, in Bulgarian levs (BGN) and including VAT (20%).

2.6. There is a "Buy" button next to each product on the page. Pressing this button saves the selected product in the virtual shopping cart of the User. By clicking the "Shopping Cart" button, the user can view the contents of the virtual shopping cart, add new products or remove those he does not want. After clicking the "Order" button, the customer's data, delivery details and re-examination of the virtual shopping cart appear. The order is activated by pressing the "Confirm order" button.

 

    ORDERING GOODS

3.1. To place an order to the e-shop, the User must specify:

3.1.1. valid email address;

3.1.2. correctly filled shipping address for the orders and invoices;

3.1.3. correctly filled contact details - two names, telephone number.

3.2. In case the ordered goods are not available, the consultant notifies the User. If the User does not agree to replace the order with another product, the order may be canceled.

3.3. Orders in the e-shop www.emart.eu are accepted 24 hours a day, 7 days a week.

3.4 The working day of the consultants of the online store emart.eu :

Monday to Saturday - 09:30 to 18:30 Sunday from 10:00 to 17:00

3.5. The user can decline an order without having to mention the reasons for the refusal.

3.6. Order cancellation can be made by phone or by e-mail (e-mail) to the e-mail address specified on the site - e-mail: dimoivaylov@abv.bg. In order for the refusal to be valid, the User must provide: the number of the order, the phone number left in the order, his two names with which he is registered on the site, the email address (e-mail) with which he is registered on the site, the price of the order .

4.0     ORDER SHIPPING INFORMATION

4.1.    Shipping of ordered goods is not not available on Sundays and public holidays.

4.1.1. Normal delivery - within 15 working days from the moment of order confirmation.

4.2     Delivery is made to the exact address specified by the User (whether residential or business) or to the office of a courier company.

4.3.    Delivery prices are specific for non-European countries and fixed for European countries.


 
       5. PAYMENT

 
           MARTBG LTD has concluded contracts for performing this service with Speedy and Leo Express. The current Public Register of Operators Licensed to Perform the Services under Art. 39 of the PSA, you can see on the website of the Communications Regulation Commission.

        6. WITHDRAWAL FROM THE CONTRACT. COMPLAINT

6.1. The consumer has the right to make a complaint or return a product purchased from the e-shop within 14 days of receiving the product.

In order to request the return of the goods, the User must notify the Seller by phone (+359 884 400 631) or by e-mail emart@abv.bg.

6.2. In case of withdrawal from the contract, the User is obliged to return the purchased goods in undamaged commercial form and with a preserved label.

6.3. Upon withdrawal from the contract, if the User has paid for the goods, the amount paid for the returned goods is refunded within 15 / fifteen / days after the return of the goods. Amounts are not refunded until the User returns the goods. If the goods are not returned within the period under item 6.1, the withdrawal from the contract does not

     produces action.

  6.4. The customer's personal bank account - IBAN and BIC, must be present in the complaint request, to which the amount paid for the goods must be refunded, the amount of the complaint is refunded only by bank transfer after receiving the returned goods!

     Amount for transport costs is not refundable!

     The transport costs for return, replacement and / or reclamation of goods at the request of the User or outside the following cases are borne by the User!

6.4. A complaint is made when the purchased goods do not comply with the agreement between the parties to the contract of sale. The discrepancy in the agreement between the parties may be expressed in:

- the goods are damaged during transportation;

- the delivered goods obviously do not correspond to the ones ordered by the customer;

- if the price to be paid does not correspond to the price at which the order was placed;

6.5. In case of a complaint, the User can choose to replace the specific item for the same without defects or another, or return the goods in exchange for a refund. An e-shop consultant may offer to replace the item with a completely different item when equalizing the prices - either the User pays extra if the other item is more expensive, or two items are offered for the same price, or the User is refunded the difference between the replaced and the new item, if the price of the new item is lower than the price paid by the User.

7.   BROCHURES AND NOTIFICATIONS

7.1. When a User registers in the e-shop by creating a Profile on the Website of emart.eu, accepting the General Terms of use, he agrees to receive in his e-mail notifications and ads from www.emart.eu, as well as emails about orders and confirmations to change his data or password.

7.2. The user may opt out of receiving notifications and ads on his e-mail and on his mobile phone at any time:

7.2.1. By replying to the notification or newsletter with the text Unsubscribe.

7.3. If, after refusing notifications User places an order, it is considered that he has again agreed to receive brochures, ads, notifications.
